III. Legal basis for the processing of personal data

The processing of personal data requires a legal basis, which we would like to explain to you in the following.

Insofar as we obtain the respective person’s consent for the processing of their personal data, Art. 6 para. 1 lit. a of the EU General Data Protection Regulation (GDPR) serves as the legal basis for the processing of personal data.

When processing personal data, which is necessary for the performance of a contract to which the person affected is a party, Art. 6 para. 1 lit. b GDPR serves as the legal basis. The same applies to processing operations that are necessary to carry out pre-contractual measures.

As far as the processing of personal data is necessary to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis.

In the event that vital interests of the person affected or another natural person make it necessary to process personal data, Art. 6 para. 1 lit. d GDPR serves as the legal basis.

If the processing is necessary to safeguard a legitimate interest of our company or of a third party and if the interests, fundamental rights and freedoms of the person affected do not outweigh the former interest, Art. 6 para. 1 lit. f GDPR serves as the legal basis.

The legitimate interest of our company with regard to the websites is in the execution of our business activities as well as in the analysis, optimization and maintenance of the security of our online offer.

IV. Deletion and storage period of your personal data

Your personal data will be deleted or blocked as soon as the purpose of the storage no longer applies.

Furthermore, storage can be carried out if this has been provided for by the European or national legislator in EU regulations, laws or other ordinances to which the person responsible is subject, e.g. in the case of statutory retention periods. Data will also be blocked or deleted if a storage period prescribed by the above-mentioned standards expires, unless there is a need to continue storing the data for the purpose of concluding or fulfilling a contract or for further processing justified by law.

As far as other storage periods exist, this is shown in the individual topics.

V. Contractual processing

Within the scope of an order or when initiating a contract, we collect personal data of contact persons and parties involved as well as other information necessary for the order. We need these data to identify you as a customer, to process the order, to answer your inquiry, to submit an offer, to contact you or for invoicing purposes.

The data processing is carried out based on our business approach and is required in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR for the aforementioned purposes for the appropriate processing of your enquiry or for the mutual fulfilment of and obligation arising from the contractual relationship.

VI. Forwarding of your personal data to third parties

The data entered by and/or collected from you will only be passed on for the purpose of fulfilling your order, for example to group companies, mail-order companies or payment service providers, or if we are legally obliged and/or entitled to do so.

VII. Your rights as affected person

You have a right to receive information about the personal data we have stored about you. According to the legal regulations, you also have the right to have incorrect data corrected, blocked, data transferred and to have your personal data deleted. To do this, please send us an e-mail with the subject “data protection”.

You also have the right to complain to a data protection supervisory authority if you believe that the processing of your personal data is in breach of the law.

If you have given your consent you have the right to revoke it at any time. This does not affect the lawfulness of the processing carried out on the basis of the consent until revocation.

You can object to the future processing of your personal data in accordance with the legal requirements at any time. The objection can be made in particular against processing for the purposes of direct advertising.

If a user calls up a website, a cookie can be stored on the user's operating system. This cookie contains a characteristic string of characters that enables the browser to be clearly identified when the website is called up again.

The purpose of using technically necessary cookies is to make it easier for users to use websites within the scope of our legitimate interests. Some functions of our website cannot be offered without the use of cookies. Thus, it is necessary that the browser is recognised even after a page change.

We require cookies for the following applications:

  • PHP session cookie (CMS administration)
  • Cookies with information on the current display (device-view) such as language and filter settings
  • Form protection against bots and spam

To find out which functions on our website set additional cookies, please refer to the individual functions below.

We set cookies that are not absolutely necessary only with your consent. You can revoke this consent at any time for future use here: Open configuration box

Your consent is voluntary and you can also use our website without accepting cookies. Cookies are stored on the user's computer and transmitted by it to our website. Therefore, you as a user also have full control over the use of cookies. By changing the settings in your Internet browser, you can deactivate or restrict the transmission of cookies. When you contact us via the available options and in particular the contact forms, your details will be stored by us to answer your questions and deal with your concerns.

As a matter of principle, data is not passed on to third parties, unless applicable data protection regulations justify a transfer or we are legally obliged to do so. You can revoke your consent at any time with effect for the future. In the event of revocation, your data will be deleted immediately, unless there is a legal exception for further processing. Your data will otherwise be deleted when we have processed your enquiry or the purpose of storage has ceased to exist and there are no other conflicting legal exceptions.

During the sending process, the user’s IP address as well as the date and time of the request are saved. Within the scope of our legitimate interests, this serves to prevent misuse of the contact form and to ensure the security of our information technology systems.

We use Hubspot CRM from the service provider Hubspot (Hubspot Inc., 25 First Street, Cambridge, MA 02141 USA) for processing form requests. You can view the privacy policy here: https://legal.hubspot.com/de/privacy-policy

EU standard contractual clauses have been agreed with Hubspot so that we have taken all possible measures to ensure that European data protection law is respected.

IV. Forwarding of data to website services

In some cases we make use of external service providers within the scope of your consent with regard to analysis, optimisation and economic operation of the online offer. This always presupposes that the third-party providers of this content are aware of the IP address of the users, as without the IP address they would not be able to send the content to their browsers. The IP address is therefore required to display such content. Third-party providers may also use so-called pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. Pixel tags can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user’s device and may contain technical information similar to logfiles. In the following we list our service providers.

If your data is to be used for other purposes, we will inform you beforehand and will only use the data if you have given your express prior consent.

1. Google

Within the scope of our legitimate interests in the analysis, optimisation and economic operation of our online offer we use services for which Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”) is responsible.

EU standard contractual clauses have been agreed with Google so that we have taken all possible measures to ensure that European data protection law is respected.

a. Google Analytics

This website uses Google Analytics as a web analysis service. Google Analytics uses cookies, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of this website (including your IP address) is transferred to a Google server in the USA and stored there.

We would like to point out that this website uses Google Analytics with the extension “_anonymizeIp()” and that IP addresses are therefore abbreviated in member states within the European Union or in other signatory states to the Agreement on the European Economic Area by Google before transmission in order to exclude any direct personal reference. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there.

On behalf of the provider, Google will use this information to evaluate your use of the website, to compile reports on website activities for the website operator and to provide further services associated with the use of the website and the Internet. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Under no circumstances will Google link your IP address to other Google data. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

For the purpose and scope of data collection and the further processing and use of the data by Google, as well as your rights and setting options to protect your privacy, please refer to Google’s data protection information under http://www.google.de/intl/de/policies/privacy/?hl=de

as well as especially regarding Google Analytics under: https://www.google.com/policies/privacy/partners/?hl=de and under https://support.google.com/analytics/answer/6004245?hl=de

as well as regarding Universal Analytics under: https://support.google.com/analytics/answer/2838718?hl=de

The data collection and storage by Google for the respective end device can be contradicted at any time with effect for the future in connection with the use under this link: http://tools.google.com/dlpage/gaoptout?hl=de

You can also prevent the collection by Google Analytics by clicking on the following link. An opt-out cookie will be set to prevent future collection of your information when you visit this website with this device:

Stop forwarding data to Google

Note: If you delete your cookies it means that the deactivation cookie will also be deleted and you will have to set it again.

b. Google Maps

This website has content from Google Maps. By visiting the website, the third-party provider receives the information that you have called up the corresponding subpage of our website. In addition, the data automatically sent via your browser, such as your IP address, is transmitted to Google Maps in the USA and stored there. The provider may store this data as user profiles and use them for advertising and market research purposes. If you are also logged in to Google, this data is directly associated with your account. If you do not want the assignment to your profile, you must log out before activating the button. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Google.

Detailed information on the purpose and scope of data collection and its processing by Google Maps can be found in the provider’s privacy policy under http://www.google.de/intl/de/policies/privacy/.

c. YouTube

We use the provider YouTube, a service of Google, to integrate videos.

These videos are stored on www.youtube.com and can be played directly from our site. YouTube uses cookies for data collection and statistical data evaluation. YouTube uses cookies to collect reliable video statistics, prevent fraud and improve user experience, among other things. The information generated by the cookie about your use of this website (including your IP address) is transmitted to and stored on YouTube servers, including in the United States. Your IP address cannot be assigned unless you have signed in to YouTube or another Google service before visiting the site or unless you are permanently signed in. If you do not wish to be logged in, you will need to log out of your YouTube account and your other Google accounts.

The YouTube cookies provide us with statistical values for the retrieval of individual videos embedded in the website without reference to the respective user.

YouTube’s embedded videos are used within the scope of YouTube’s permitted use, which all users must accept. If you see any copyright infringement, please report it directly to YouTube. We use embedded YouTube videos in an enhanced privacy mode. This means that YouTube does not store cookies for a user who views a website with an embedded YouTube video player, but does not click on the video to start playback. When the YouTube video player is clicked, YouTube may store cookies on the user’s computer. We would like to point out that we, as the provider of the website, have no knowledge of the content of the transmitted data or its use by YouTube. For more information about YouTube’s official privacy policy, please visit https://www.google.de/intl/de/policies/privacy/ and https://support.google.com/youtube/answer/171780?hl=de.

d. Google Tag Manager

We use the Google Tag Manager. This enables us to manage website tags via an interface and thus integrate e.g. Google marketing services into our online offer. The Tag Manager itself does not process any personal user data. For the respective Google services, please refer to the respective notes and the usage guidelines under https://www.google.com/intl/de/tagmanager/use-policy.html.

e. DoubleClick

We use the online marketing solution Google "DoubleClick" to integrate ads in the Google advertising network. DoubleClick is characterised by the fact that ads are displayed in real time based on the presumed interests of users. This means that ads within our online offers are displayed in a more targeted manner, and users are only shown ads that potentially address the user’s interests and in which they have already expressed an interest on other websites in the network, for example (“Remarketing”). For these purposes, when you visit our website and other websites on which the Google advertising network is active, a code is executed directly by Google and so-called (re)marketing tags are incorporated into the website. Hereby an individual cookie is set on the user’s device (instead of cookies, comparable technologies can also be used). The cookie records which websites the user has visited, what content the user is interested in and which offers the user has clicked on, as well as technical information on the browser and operating system, referring websites, visiting time and other information on the use of the online offer.

The IP address of users is also recorded, although this is shortened within member states of the European Union or in other states which are party to the Agreement on the European Economic Area and only in exceptional cases is it transmitted in full to a Google server in the USA and shortened there. Google may also combine the above-mentioned information with information from other sources.

User data is processed pseudonymously within the Google advertising network. Thus, from Google’s point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who that cookie holder is. This does not apply if a user has expressly permitted Google to process the data without this pseudonymisation. The information collected by Google marketing services about users is transmitted to Google and stored on Google’s servers in the USA.

Further information on the use of data by Google, setting and objection options, can be found in the Google privacy policy (https://policies.google.com/technologies/ads) as well as in the settings for the display of advertising by Google (https://adssettings.google.com/authenticated).

f. Google reCaptcha

For protection against improper use, we use the identification service Google reCaptcha on our website. The query with reCaptcha serves to differentiate whether the entries in the web page form are made by a human being or abusively by automated machine processing. The query includes the sending of your IP address to Google and other data required by Google for the service reCaptcha. This data is transmitted to Google’s servers, where it is stored and processed. Under certain circumstances, Google may pass on the collected data to third parties. We would like to point out that we, as the provider, have no knowledge of the content of the transmitted data or its use by Google. Google’s data protection regulations apply to this data. In the respective reCaptcha window, you will find a corresponding link to the current data protection regulations of Google Inc. under "Data protection declaration". You can also access these under https://www.google.com/intl/de/policies/privacy/.

You can avoid the corresponding data collection by not using the reCaptcha function. We would like to point out that no requests can be sent in this case.

2. Facebook

Within the scope of our legitimate interests in the analysis, optimisation and economic operation of our online offer, we use services of the social network facebook.com, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”).

EU standard contractual clauses have been agreed with Facebook so that we have taken all possible measures to ensure that European data protection law is respected.

Facebook Social Plugins

Our website uses social plug-ins (“plug-ins”) from Facebook. The plug-ins are marked with a Facebook logo (white “f” on a blue tile, the word “Like” or a “thumbs up” sign) or the addition “Facebook Social Plug-In”.

We use the so-called 2-click solution. When you visit our site, no personal data is passed on to Facebook. Only if you activate the plug-in, your browser will establish a direct connection with the Facebook servers.

The content of the plug-in is transmitted directly to your browser by Facebook and integrated into the website by it. In this way, personal information such as your IP address, URL, date and time and other browser-related information is transmitted to Facebook and stored in the USA. According to Facebook, only an anonymised IP address is collected in Germany.

If you are logged in to Facebook, Facebook can assign the visit to your Facebook account. If you interact with the plug-ins, for example by clicking the “Like” button or making a comment, the corresponding information is transmitted directly from your browser to Facebook, saved there and, depending on your Facebook settings, communicated to your Facebook contacts. If you do not wish to do this, please log out of your Facebook account (before clicking the opt-in button).

Facebook stores your data as user profiles and uses them for the purposes of advertising, market research and/or the needs-based design of its website and other websites. For this purpose, Facebook uses cookies and similar technologies to show you advertisements on the Facebook services as well as outside of them, regardless of whether you have an account with Facebook and are logged in. Facebook already sets cookies for this purpose when you visit www.facebook.com and forwards your data to third parties.

We would like to point out that we, as the provider of the website, have no knowledge of the content of the transmitted data or its use by Facebook. You can prevent the installation of these cookies by changing the settings of your internet browser to reject all third-party cookies; however, we would like to point out that in this case you may not be able to use all the functions of this website to their full extent. The purpose and scope of data collection and the further processing and use of the data by Facebook as well as your rights in this regard and setting options for protecting your privacy can be found in Facebook’s data protection information under http://www.facebook.com/about/privacy/, and specifically for Facebook’s social plug-ins under https://de-de.facebook.com/help/443483272359009/.

You can also change your privacy settings on Facebook in your account settings.

3. Hotjar

We use Hotjar, a service provided by Hotjar Ltd, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe, to better understand the needs of our users and to optimise the services on this website. Hotjar’s technology allows us to gain a better understanding of our users’ experiences (e.g. how much time users spend on which pages, which links they click, preferences, etc.) and this helps us to tailor our offering to our users’ feedback. Hotjar uses cookies and other technologies to collect information about the behaviour of our users and their end devices, including but not limited to the IP address of the device (collected and stored only in anonymous form), screen size, device type (unique device identifiers), information about the browser used, location (country only) to display the preferred language of the website. Hotjar stores this information in a pseudonymous user profile. The information is not used by Hotjar or by us to identify individual users, nor is it merged with other data about individual users. For more information, please see Hotjar’s privacy policy here.

You can object to Hotjar storing a user profile and information about your visit to our website and to Hotjar tracking cookies on other websites by clicking this opt-out link .

4. HubSpot

On this website we use HubSpot for our online marketing activities. HubSpot is a software company from the USA with a branch in Ireland. Contact: HubSpot, 2nd Floor 30 North Wall Quay, Dublin 1, Ireland, Phone: +353 1 5187500. EU standard contractual clauses have been agreed with HubSpot so that we have taken all possible measures to ensure that European data protection law is respected.

This is an integrated software solution with which we cover various aspects of our online marketing. These include:
E-mail marketing (newsletters and automated mailings, e.g. to provide downloads), social media publishing & reporting, reporting (e.g. traffic sources, access, etc. ...), contact management (e.g. user segmentation & CRM), landing pages and contact forms.

If you do not wish to be recorded by HubSpot in general, you can adjust the consent given by the cookie banner for the storage of cookies at any time or prevent their use through your browser settings accordingly.

C. Data collection and use in social media

You can find us on various social media platforms such as Facebook (see the following list). With these profiles we would like to communicate with our customers, interested parties and active users and inform them about our services and our company.

The processing of the personal data of the users active on these platforms is based on our legitimate interests in communication and information provision to and with the users. Insofar as users have given their consent to data processing within the framework of the respective social platform, the processing is carried out on this basis of consent.

If you visit one of our social media sites, we are jointly responsible with the operator of the social platform for the data processing operations triggered during this visit. You can basically assert your rights to information, correction, deletion, restriction of processing, data transferability and complaint (see point “Your rights as affected person”) both against us and against the operator of the respective social platform.

We would like to point out that, despite the joint responsibility, we do not have full influence on the social platform’s data processing procedures and, if necessary, for a better processing of the affected person’s rights, we forward the rights request to the respective operator. Our possibilities are essentially based on the company policy of the respective provider.

You will find our storage information above. We have no influence on the storage period of your data stored by the social platform’s operators for their own purposes. For details, please contact the operators of the social networks directly (e.g. in their privacy policy, see below).

Depending on the following designated social platform, the processing of users’ data may also take place outside the territory of the European Union. EU standard contractual clauses have been agreed with the US companies so that we have taken all possible measures to ensure that European data protection law is respected.

User data is generally processed by the platforms for market research and advertising purposes. For example, user profiles can be created from the user behaviour and the resulting interests of the users. The user profiles can in turn be used, for example, to place advertisements inside and outside the platforms that presumably correspond to the interests of the users. For this purpose, cookies are usually stored on the users’ computers, in which the usage behaviour and interests of the users are saved. Data can also be stored in the user profiles independently of the devices used by the users. This occurs in particular if the users are members of the respective platforms and are logged in to these.

For a detailed presentation of the respective processing and objection options, we refer to the providers’ information linked in the following.
